Updating Terms and Conditions: We may update these Terms and Conditions from time to time. You can review the most current version of these Terms and Conditions at any time at: http://outboundindex.org/terms.cfm.
The following constitutes a legally binding agreement between the companies who own the domain(s) you verify control over (hereinafter referred to as "you"), and Server Authority Inc, a Rhode Island USA corporation, hereinafter referred to as "we" or the "Outbound Index").
Membership Requirements:
The Outbound Index is a membership organization. If you do not agree with the following, do not join as a member.
- "Free speech" should not guarantee the right of a sender, including advertisers and address harvesters, to force any service provider to receive, store, or deliver email, includingbut not limited tobulk email.
- Senders should not have the right to utilize the networks or computing resources of recipients or recipient ISPs to attempt to deliver email which the recipient or the recipient ISP determines it does not want to accept.
- Domain ownership records should accurately reflect the legal contact information for the domain owner, and owners of multiple domain names should have the same name spelling and legal contact information for easy cross-referencing.
- Senders operating in a manner which makes their email difficult to discern from spam (i.e., using practices, techniques, networks, or addresses used by spammers) have the responsibility to alter their practices to make sure their emails are not mixed in with spam, and should expect and accept flagging, rate limiting, and other spam mitigation meausures if they are unable to alter their practices to differentiate their email from spam.
- A member's status can be altered based on observation of their emailing practices and that status can be publically disclosed, including if the member chooses to discontinue membership.
Your specific responsibilities:
- Fail-safe configurations: You agree to only operate your email servers in fail-safe configurations, which will continue to operate and accept email even if the Outbound Index service is unavailable.
- Access via a fixed IP address, or accept risks: You agree to access the Outbound Index services only from a fixed (static) IP address, without the use of a proxy which alters the internet IP address of your workstation, or to accept all security risks of the usage of a proxy or dynamic IP address, and to take additional security options available such as ordering an RSA SecurID token.
- Truthful information: You agree that any information you provide is true, accurate, current, and complete. Example: Any IP addresses you list as "unauthorized"forbidden to operate an email server on your networkmust be an IP address which is under your control and one for which you forbid operation of outbound email servers. If you provide any information that is not true, accurate, current, and complete, other members of the Outbound Index may trust your email differently than they trust email from Members in Good Standing.
- No robotic data extractions: You agree not to use a robotic device to extract data from or input data into any Outbound Index web page, unless you have applied for and received a special license directly from the Outbound Index.
- No hacking: You agree not to test the security of or hack the Outbound Index production site or production servers. If you wish to conduct "ethical hacking" tests, you may be provided with non-production addresses for testing upon making a reasonable request.
- Software/configuration liability: You agree that we do not create or sell software for use on your mail servers and bear no responsibility for the configuration of your email server software.
- Domains and server listings: Your domains and associated servers may be listed on the Outbound Index regardless of your Member Standing.
- Usage credits: Outbound Index usage credits have no cash value and may not be resold to others, given away, borrowed, repaid, or refunded.
- Data usage: Other than an unarchived cache and mail server logs which are not mined for Outbound Index data, you may not retransmit or store data obtained from the Outbound Index queries or web pages except by obtaining a special license to do so.
- Suggestions and data: Suggestions and data you submit which are not in the public domain become the property of the Outbound Index.
- Ending your membership and data:If you choose to end your Outbound Index Membership, we may retain and transmit data gathered from you about your outbound email servers, for a period of five years after you end your Membership. We may retain and transmit data gathered relevant to your outbound email servers from other sources without time restriction.
Our specific responsibilities:
- Ethical standards: Uncompromising ethical standards.
- Overall goal: All operations support a reduction in unauthorized email.
- Main responsibility: We will provide and maintain an open community environment designed to improve the efficiency of the Outbound Index and support development of tools for the Outbound Index.
- Data transmission: We will transmit reports and query responses that accurately reflect both the content of the database and the program logic at that moment when an internet connection exists between your computer and ours.
- Examples: We will provide examples of software and configurations that have worked for others who access the Outbound Index service.
- Vendor lists: We will provide lists of vendors on the Outbound Index site, but in doing so we are simply listing vendors used by others. Our listing of these vendors is not to be construed as a recommendation, nor can we guarantee the fitness of any vendor.
- What we will not do with your contact information: We will not rent, sell, share, give away, or otherwise pass along the contact and/or email information you have provided to us, in any way whatsoever.
- What we will do with your contact information: If you choose to give us your email address, we will use it only for the purpose you request at the time you give us your address.
- Changes to how data is displayed: Data available on the dashboard may change from time to time as query volume increases. For example, we may present some data in summary form rather than in detailed form, or details may be available for the past hour instead of the the past 24 hours.
- Archiving: High volume may lead us to archive historical data, and different rules may apply to the access of that historical data.
Liability
The laws of the State of Rhode Island shall apply to the interpretation and/or enforcement of these Terms and Conditions. Any dispute regarding the interpretation and/or enforcement of this agreement shall be resolved by submitting the same to mediation through the American Artitration Asssociation (AAA). If the parties are unable to resolve any disputes through mediation within twenty (20) days from the commencement of mediation, the parties shall submit to the same to binding arbitration (unless such period is mutually extended by the parties in writing), in accordance with the rules and the procedures of the AAA. The arbitration ruling shall be final and binding on the parties. Notwithstanding any AAA rules/regulations to the contrary, the fees, costs, and expenses of the mediation or arbitration of any such dispute shall be paid equally by both parties.

What happens when I join?
You will be asked what your email domain is. If you have a trusted CA SSL certificate on the webserver at www.youremaildomain.com or youremaildomain.com, you will simply submit the https address and you can become a member. If you do not have an SSL certificate, you will initiate a payment transaction of at least $1.50, to establish a connection between you and a verified identity (credit card or bank account).
Once you have identified yourself in either of these two ways, you will be able to move on to the process of listing your domains and their associated authorized servers (and those not authorized) in the Outbound Index. As few as three simple pieces of information will be entered by you into the Outbound Index to accomplish inclusion of all domains under your control.
After authenticating ownership and/or control of your domain, you will receive 25,000 Usage Credits and immediate access to the Outbound Index Dashboard.
Note that self-signed SSL certificates won't be accepted, nor will the type of certificate which only verifies that a domain registration contact responds to email, even if issued by a trusted Certifying Authority.
